2007 Pet Food Recall Claims May be Paid Soon

Pet owners who filed claims after the 2007 Menu Foods pet food recall may finally have a small bit of closure to their nightmare. Due to a court ruling today, those claims look like they’re going to be paid.

The opinion by Judge Noel Hillman in U.S. District Court in New Jersey was the last piece of court action required to put to rest appeals of a $24-million pet food settlement approved by Hillman in October 2008.

“I am hopeful that we can begin processing claims shortly,” said Lisa Rodriguez, liaison counsel for the multiple class-action suits covered by the settlement.

According to court documents, 24,344 claims were submitted by the Nov. 24, 2008, deadline. Of those, 20,550 have been deemed payable. The average claim is about $1,283. Allowed expenses included medical attention, lost wages, property damage and the price of replacement pets. The settlement covers claims by owners in the United States and Canada.

The Veterinary Information Network, an online professional community and parent of the VIN News Service, estimates that between 30,000 and 50,000 animals were affected, judging from member surveys and tracking. The U.S. Attorney’s Office has estimated that about 1,950 cats and 2,200 dogs died, based on consumer reports received by the U.S. Food and Drug Administration.

More than 100 class action lawsuits filed in the wake of the poisonings were addressed by the court settlement of October 2008. Pet owners were invited to submit claims immediately, but payment of the claims has been delayed since then by two court appeals.

I’m fortunate. I didn’t lose a pet to the recall, but I know a lot of people who did, including my sister. I know it’s been a painful road to go down – first seeing a much loved pet suffer and possibly die, and then dealing with companies and courts that didn’t seem to give a damn. There’s no way the settlement will make everything right for anyone who had pets who were affected by the melamine-tainted pet food. Period! My hope though, is that it will at least help with some type of closure.

On a sad (but predictable) note, as seems to be the norm for the pet food industry, VIN posted the news about the court decision before it’s even on PetFoodSettlement.com.  That’s the website set up to inform pet owners about the lawsuits.

 

UPDATE: June 10, 2011
There were a number of posts claiming to have received very small settlement checks. They were bogus posts and have been removed. As of today, no settlement checks have gone out yet.

I am blessed that my cat made it though…..although it was very rough going for quite a while. He is more important to me than almost anything or anyone. Good luck to all of you. MN. here checking in. Four claim checks arrived today.#15xxx.
Original amount submitted was $11,138 rounded.
First letters stated eligible amount $5682 documented, $1365 undocumented. This may have been total gas spent since all facilities except one, are over 35 miles one way.
There was an issue that I apparently had claimed the total gas on each claim so they had to break it up.
I submitted pretty heavy documentation as I also submitted records from Petco, Petsmart, Vets, etc…. and included photo documentation of my pets, surgeries photos, pet photos, empty recalled packages and cans of consumed petfood, etc….our “facts” package was 1/2 + thick.
The amount they said that we were eligible for was 7046 rounded. Of which we received four checks today totaling about $3650 thereabouts.
I am deeply saddened beyond grief because one is now dead, another having a hard time living, four dogs with massive tumors the size of grapefruits, multiple other issues like a kidney stone in my one cat that the vet could not believe the “composite makeup of thru the lab”, two dogs having kidney control issues, two of my five cats struggling to maintain with kidney function and they are heart defective also. We have had multiple horrific cysts and tumors all over.
The bills accumulated back then were even higher but I did as a good person does and claimed what I could prove. I did not claim emotional damages, income lost (self employed), the loss of my own ability to buy a prosthetic (used it for vet emergency hospital costs, etc…) that I needed that I had gone to prepare for, the fact that charges on our charge cards had fees, interest, did not even charge for ruined carpeting which I myself tore up and did not replace yet. Cannot afford it.
Bills since have been in the thousands still and ongoing.
So in conclusion, we can pay off the last round of charge card instead of my husband taking it out of his retirement savings again. We will have a little money for a surgery and to buy our cat some $200 meeds that the Vet now wants to put him on since he is now anemic.
I am hugely sorry for all of us. Those that have lost loved four-leggeds and those whose pain endures every day also with the survivors.
Because we were on top of this when we first found out, or pets survived with damages, it is difficult. I know people who lost pets and never knew there was even a Class action lawsuit. The Corporations did everything possible to hush this all in order to pay out less and to stop the bad press and facts of their crap that they sell getting out.
I think we should hang together even if we cash checks. I need to cash ours because we live on one retiree income of the lower middle class.

The amounts are a joke, we know that.

You’re so right about the corporations doing what they could to hush everything up. Their PR machines were hard at work trying desperately to get past the bad press. And in doing so, people and pets like you and your pets have long been forgotten by most. People remember (some, anyway) that during the recall pets died. But what hasn’t been talked about as much is the pets, like yours, that are still hanging on and suffering as a result. The awful truth is, as you alluded to, there are way more pets out there who are suffering (or dead) because of all this than we’ll ever realize.

This is so true. I remember that several months before the recall was announced – an apt complex in my area had posted signs around it about someone was poisoning their cats. The sad truth is the owers or whoever was feeding the strays was probably doing it without realizing the food was poison.

I do not believe we could have come out with more had we found individual legal representation. In a class action suit, the attorneys will always end up with around half the money, 25% in fees, and whatever they can prove are expenses. We didn’t make anyone rich- we just got representation as a very large group. None of us were ever going to get 100% in a class action suit.

I believe that our best hope was to do a class action but had I had time, I would had asked for 100% directly from Companies prior.
New Supreme Court decisions will make it even more difficult to do Class actions. WE got in under the wire.
One would had hoped that there would have been the opportunity for greater publicity on this. I think the value in hanging together would be to, after all of the checks have arrived, to write our stories, as short and concise as possible, the end financial results as well, and send them ALL to one place. One Investigative journalist or one Media Outlet that would indeed cover this and what the Industry(s) do to pets and owners.
If we can agree on a person of high profile and integrity, getting mailed hundreds of stories with pics included, would be possibly enough to keep this story alive.

Individual representation would have been hard to find, and even if an attorney had accepted a case, he/she would have taken it on a contingency basis, meaning, if it settled before trial he/she would take 30-33% if it went to trial he/she woulf get 40+% plus cost and fees. It sucks I know, but we came out better this way. A jury could have “pulled a casey anthony” and given a big fat zero. I live in FL, and no check yet, but when it comes, puppy gets a big steak and his favorite chic-fil-a ice cream, and i don’t care if he does puke on the carpet afterward.

I will use some to pay a vet bill, some for a big juicy steak and some ice cream for a well deserved doggie and am donating a portion to the rescue group that I got my “replacement” doggie from. I’m glad its over. You all know the “God Grant me the Serenity” prayer, right? I’m saying that and praying for the souls of your lost ones and also praying for everyone to just find peace as a whole.

I checked out hiring my own lawyer because I had all of the documentation from the animal hospital and the vet bills, food receipts,and lots of the recalled food. I would have had to pay the lawyer upfront and then sue for the out of pocket costs as well as attorney fees. In Texas (not sure about other states) pets are considered possessions, not family, so there is no recouping money for pain and suffering. You could only sue to get your expenses and attorney fees reimbursed. After talking with menu foods – I thought that was what they agreed to but live and learn…

I just received a settlement check for half of the amount I was deemed entitled to. This is because out of $24 MILLION, a fund of only $250K was set aside for pet food claims. So my cat died in great pain, at great emotional pain to myself, and great expense to save her. I thought that was the point of the fund?! Feels like an insult to what she went through. I wasn’t aware of the “healthy pet screening fund”, which reimburses at 100% of the $440K available. That fund has not been exhausted, so apparently the balance will go to animal charity. You would think they could transfer funds so those of us who went to all the trouble of documenting and submitting a claim could be better reimbursed. At least we get something, certainly not justice for Serena, my sweet deceased cat, but I can’t help but wonder…who gets the rest of that $24 MILLION? Certainly not the animals nor people who suffered!

I guess I am just catching onto this. So only$250,000 was allotted to pay back people who have had their animals sickened or killed by this but $400,000 was allotted to test them. So that is 650,000 out of 24 million. Hmmmmmm something is wrong with this picture. 🙁

I don’t think those numbers are right. I think the $250,000 was pet food, the $400,000 was well pet testing, and after lawyer fees and expenses – everything else was claims. Of course not sure what lawyer fees and expenses ran but I am sure they got theirs. We got the leftovers.

Exactly. 250K was set aside to reimburse for the pet food that was purchased and thrown away. This has nothing to do with vet bills, etc, it’s just a cap on reimbursement for tainted food. Vet bills, cost of deceased pets, etc comes out of the general fund.

I recevied my check on 7/18/2011 in the amount of $37.57….I am very upset, discussed and humiliated with the amount. I still have a vet bill to pay. I sent in my claim with everything they needed. My Bandit died and I am still sad. This is no closure for me. The letter they sent broke down the monies but I don’t understand a word they are saying. My letter even stated and I quote” The amount that you already received in the prior settlement or reimbursement of your claims was then deducted.” Well I never had another claim nor did I get monies from any other place. What the hell are they talking about? I wish I could fight this but I know I can’t. What can I do with $37.57?

I’m in Hamilton Ontario Canada.. I have not received any checks as Friday July 22nd. From what I am reading though from our neighbours south bound of us, this is scaring me. It’s bad enough our precious family pets hae either died or suffered from this tainted food, but now it feels as though we’re all going to get robbed. How is this called Justice?

I’ve been watching this for some time…. quite the fiasco…. I’m in Nova Scotia, and considering our recent postal strike, attriubuted the lateness to that…. However, as of Monday, July 26th, I’ve not recieved anything other than heartache…. I’ve emailed the Claims Administrator questioning if the US notice (ref cheques) was applicable to the Canadian website. I guess the cheques in the mail….

. Hi Shirley… I wrote the claims administrator also, about a week after our postal workers went back to work. I never heard back from them at all. and I don’t believe they will write us back. Well it seems our neighbors have their cheques coming in now, and I am thinking we won’t see ours till the later part of next week, from August 10th on wards. I am thinking the lawyers here are holding off sending us payments so they can collect the interest for July as well, and no doubt it will be in Canadian funds.. For these lawyers it was nothing but a money grab for them. They were the winners in all of this. I guess Class action lawsuits don’t benefit the clients at all.

Agreed, but I didn’t go through lawyers, but submitted my claim directly. Like all the other pet owners going through this processs, I have a “heavy heart” and it was very difficult to complete the forms reliving each moment our beloved pet was dying … We have since changed our pets’ diet….. we generally prepare their food and if purchased (such as dental bones, etc.), verify all ingredients and origin….. Some lessons learned….the pet industry is BIG business – at every angle…. buyer beware….

Hi Shirley… I got my cheque this past Friday July 29th. I did phone the claims admin. the day before and they left a message on my answering machine if I don’t receive my cheque by the Monday August 1st to phone them and they will issue me another cheque. I deal with the Scotia bank and they told me they will put a 21 day hold on the cheque until the funds can be credited to my account. They want to make sure the cheque clears first. PLUS, we will lose 6 cents on the dollar because of the exchange rate. I am considering driving to the US since I am only an hour away from the boarder to cash my cheque at the Bank of America. Only thing I am afraid of now is what will happen as of Tuesday with the US credit rating. It makes me wonder if their dollar will drop anymore and that means we’ll lose more off our cheques when converting the money to Canadian. I hope you get your cheque on Monday. If not give them a call and raise hell.

I’m glad to hear that some people in Canada have received their cheques. I have been emailing them (several times in face), but of course I haven’t received a reply. I wasn’t even sure what was going on because they haven’t updated the Canadian portion of the web site since April.

I still haven’t received anything, but maybe there will be something in the mail today. I live in Cambridge Ontario. I will call them if there is nothing in the mail today. Did you call 1-800-392-7785?

I lost two sweet little girls (cats), one right away, the other years later but with decreased kidney function. I just said good-bye to Sarrah this past May, so I know it will hit me hard once I finally receive closure (although still pretty pissed at the way we all got ripped off and the lawyers sure made a killing)…

I phoned my bank here in Southern Ontario and they told me they would put an automatic freeze for 21 days until the cheque clears. Plus they would charge me for the exchange rate. My bank, Scotia, converts the US cheque to Canadian money so you automatically lose. Only way around that is for me to pen a US bank account here. Still have to wait for the 21 days for the cheque to clear though. Seems we’re getting ripped off every which way. . .

Yes that is the correct phone number, 1 800 392 7785 and their email address is, claims@petfoodsettlement.com. I had called them on the Thursday of July 28th and left a message I did not receive my cheque as of yet. Although on the following day of the 29th my cheque did come in. They also phoned me back on that day leaving a message that if I had not received my cheque by the Monday of August 1st to call them and they would reissue me another cheque. The letter you received back in April has the claims number on it, just below their mailing address. I think it helps to speed everything up from their end to find your file as I had received a call back from them pretty quickly.

I didn’t discover this blog until the 3rd week of this past July. I know it helps bring some comfort and anger too, reading everyone’s comments about this issue. What we all have endured, watching our pets die and even to continue to suffer is criminal. This was an act of negligence and financial greed from the way I see it. Just why hadn’t this wheat glutton been tested before it was used in pet food? What guarantees do we have this won’t happen again? After receiving my cheque it certainly didn’t feel like there was any closure to any of this. I hope you get your cheque today, if not give them a call.

Got my check in Washington State today. Yes it was 52.1% from the Bank of America. I admit that I am kind of glad those trolls set us up for thinking we were going to get almost nothing, because getting half is better than I was expecting at one time. I just wish I could feel safe when I feed my dogs every night. Anytime they give me a funny look when I put the food down, I panic a little inside. I wonder if that worry will ever go away.

I know that look! It freaks me out everytime and I snatch up their food and give them carrots and potatoes until I buy more more food that day and they give me the “it’s cool, mom, we think its ok.” I don’t know how many times since 2007 they’ve eaten cheerios for breakfast or apples, bananas, carrots and potatoes for dinner, or scrambled eggs (their fave) until i get reassurance that the bagged food is safe. They also love my homemade chicken and rice with celery, carrots and potatoes. Thats what the vet prescribed when my baby shih tzu was so sick from the melamine-laced poison food. It’s all she would eat until the end. From a silver spoon, of course.

I live in Iowa and received my check today.Although i believe that we should have been awarded atleast what we had proof of ,as far as vet bills, ect, I am also glad i didnt just recieve a coupon for a Free Bag of Dog Food, which would have been a Huge punch in the stomache. I have heard many of Horror stories about class action lawsuits. I wonder how much we would have been awarded if you subtracted the people that made claims who didnt have any impact from the petfoodrecall.And yes, i have read posts from other websites where somepeople were doing that because they believed if they did that it somehow proved to these companies that they need to be held responsible for there actions.But,Do they realize that they are only hurting the actual people that had pets affected or do they really care and are only doing it to try and get “free Money”? I cant believe this is finally over after more than 4 years! From the looks of it, i also received roughly 52% of my original claim amount.

I received my claim check yesterday when I got home from work…My original documented amount was a little over $5000.00….I received $2552.00 which was 52.10%…I live in Alabama with the zip code of 36862…I’m very glad that it’s over, I thought when I got the check it would somehow help…It only brought back so much hurt and suffering that I saw my poor Lucy go thru….I’m glad we have had this site to relate with one another…My thoughts and prayers are with all of you…It’s one of the hardest things I’ve ever had to endure…

Bernadette- When we received the letter in April, what did your letter say as far as Undocumented versus Documented,ect.? Maybe they made a mistake with your check. I would call the Claims administrator and question the check amount, it cant hurt to check and see if indeed there was an error….. But i am curious what your letter you received said, that would explain if the check is correct or not. Let us know, Nicole

God bless us all and our pets- we did the best we could for fighting for our pets and our rights- we were treated poorly- but we did not give up- I hope all of you will be ok-I am glad it is over, but deeply sadden!

I received my check today in florida hoping it would be half of what i sent in. What a slap in the face, how can they do this to us. I sent in 4,500 and got a check for 1,510.00. I had all of my documents in a file and had all vet bills in order. This will not even pay for anything on my credit card interest. It really hurt me, when i got my check. I guess the lawyers won this and we got the left overs. I am glad this is done and do not have to wait any longer. Hopefully my family and I can put this horrible tragedy at rest. We miss our sweet Mollyanna and lost my little angel to soon.

In CA I received mine at the 52.1% for the under $1000 documented bill. But, I went to Bank of America which is closer to me than my bank and they wanted $5 to cash it because I didn’t have an account. They said that company didn’t want to pay for non customers to cash it for free at that same bank. I was disgusted. I went to my bank and it took care of that but that was very low to have that kind of arrangement. That’s in line with the behavior of the administrator.

We went to our credit union today and deposited the checks. She asked me if I needed cash at all. That was amazing. Especially since our bank receipt showed the only money we had was what we had just deposited. She said how sorry she was that this had happened to us and our pets.
I told her my vet bill today was 350 plus for tests and meds and I still was trying to locate the new 200 dollar meds for our kitty.
She felt awful and yet she had never even heard about the poisonings.

The claims admin.saidon there website that all checks were mailed on the 15th and too expect 7-10 business days to get them. I live in Iowa and received mine on the 19th. Not sure about Canada, i did not see a seperate post on the Canadian page, so i assume they were mailed out the same day. I wouldnt hurt to call the claims admin. though and ask if the checks were mailed out on the 15th for all Canadian Residents also. Good Luck, I hope you get it soon so you can be done with all of this nonsense with the rest of us.

Got mine on Friday July 29th. My bank wants to put a freeze on the check and hold it for 21 days until it clears from the Bank of America. Guess our banks don’t trust yours. Plus I will lose 6 cents on the dollar for the exchange rate. This is a double kick in the butt for us. Feels like they want to shove their foots up our butts too.

I received my settlement July 19th 2011, and it was for half of what the claim letter they sent, said I would receive.Also I had all the documents needed except proof of purchase of the food, which in my opinion who would have kept all those food receipts.

I received my 1 check for $98.00.I had 3 claims for my 3 little dachshunds.Sure doesn’t seem fair.They paid nothing for 2 of my dogs even though I had the vet bills.Totally disgusted and sickened by this.

Hello Everyone..

I just joined this forum a couple of days ago. I came across it by accident when I was looking for any updated information on the pet food payouts. It breaks my heart reading your posts. I am so sorry for you all. I too lost my dog, a Miniature Schnauzer named Misha. I loved my dog dearly, as you all know how a cat or dog can capture our hearts. Well since Misha had died in my arms on the way to the vets I have lived in guilt ever since. I do feel as though I had killed my dog, I miss her terribly. From what I am reading the lawyers have gobbled up the lawsuit money like vultures. If anyone decides to pursue this matter any further, count me in. I am disgusted with the settlements I have been reading. What a slap in the face this is to you all, to us all. It’s a total insult. I think sending the media a copy of our payout documentation and a copy of what has been paid out along with a letter is an excellent idea. Wouldn’t hurt sending copies to that presiding judge that ruled over Pet Menu too. I now have two cats and I also am afraid every time I am feeding them. I am considering about buying a recipe book online for pet food and making my own pet food. I don’t trust Pet Menu any longer nor any products that come in from China that I had boycotted since my dogs death. I wish you all the best, and your pets that have survived this horrible pain and suffering. Now I wonder what I should do with the tainted dog food I still have in my possession?

Has any Canadian received a cheque yet?

today July 29th I received my cheque. My claim was for $1,432.00, I received $573.45. It doesn’t even cover the cost of getting another Miniature Schnauzer. This feels like a real kick in the ass, insulting. Like you all I too lost 52% off my cheque. Plus here in Canada the bank told me they will hold the chque for 21 days for the cheuue to clear, plus I loose 6% having the money converted to Canadian funds. Where is the justice in this crap? I am totally pissed.

Obviously the attorneys and others were working for Menu Foods because if they were not, they would have gone for 100% damages for Class action members and then added their costs on top of everything.
Menu Foods and related parties made off like robbers.

You know I am having a hard time trusting the pet food industry now. It does bring me some comfort that our Canadian Government is being cautious about what meets codes. I had found out that after this all happened all beef pet products had been taken off the shelves here. You couldn’t find a can of beef for your pet anywhere. The Canadian Government had put on restrictions the grade of the food that can be sold now. Beef pet food is now trickling in but there is only a few brands available, certainly not like before. I had boycotted all food products that come in from China, for both human and pet consumption. As for Pet Menu and what happened to us all with our pets, I firmly believe in one thing. What comes around goes around. Probably not, but I hope they are hurting financially. Sorry to say that to those that are working for the company.

I sent in DOCUMENTED bills for $6,300.
I received a check today, Aug 31, 2011, for only $2,000!
I was told by ‘Marino’- at the accounting firm, that I was only reimbursed 49% of the amt of poisoned food I bought. ha!!! I had to pay for poison?
I was only provided 30 % of my costs of vet bills! They said it was NOT COST- it was economic damages…so since I put it in the wrong catagory I am screwed and No appeal nor corrections to thier messed up paperwork and directions, will be given. holy shit!
When I called the accounting firm-to ask WHO did my case calculations and HOW they were calculated…they hung up on me and said YOU can not appeal their decision! They are simply the accounting firm- not the judge nor decision maker!
My hunch is only FIVE wordS: LAUNDERING OUR AWARD OF REIMBURSEMENT!!!!??

The amount of inconsistencies in settlement and assertively apparent unco-operation should be able to be reported somewhere but I do not know where. I never received the copies that I asked for to justify they’re removing $3000 from our final amount.
This whole thing still makes me sick.
My poisoned cat is now at stage four. He has anemia and other issues all from this incident. We have $700 left from the amount we received after paying Vet bills. I am afraid to touch it but will have to take at least $300 out next week minimum for bloodwork, etc….
I am sorry that this has also happened to you too.

This is OLD news.!!!! Stop posting this crap! The law suit did pay out already!
We only got an 1/8th of what was promised!
My bills were $6,000! I only got reimbursed $2,000! I hate Proctor and Gamble and the Attys who used us, to make a shit load of money on our dead beloved pets.

Debra, you’re right. This is old news. But if you would have looked at the date, you’d see the original post was on April 5, 2011 – before the payments were made. I understand your frustration and your hatred for Proctor and Gamble but there’s no need to shoot the messenger. I wrote this blog post in an attempt to keep people informed of what was going on with the settlement, before the checks were sent out
